The website is owned and operated by Tiberius Art Studio and Richard G. Tiberius.

Tiberius Art Studio and tiberiusart.com is apprreciative of your interest and we value the time you have spent viewing our artwork. We know your privacy is important to you. Accordingly, we have implemented this Privacy Policy to inform you of the personal information that we collect from you when you visit this website, whether on desktop or mobile device, and via all other interactions with Tiberius Art Studio, Richard Tiberius, and Kiry Tiberius offline, what we do with your personal information, and how you can exercise your privacy rights.

We do not sell nor rent your information to others for money or any other purpose.

  • You have the right to opt-out of marketing communications we send you at any time. You can exercise this right by clicking on the "unsubscribe" link in the marketing e-mails you receive. Alternatively, your may contact us via the Contact page. Please include your complete name, e-mail address and mailing address and explain your request, in detail, . Note that it may take up to 2 weeks to remove you from our marketing lists and after this point you may still receive customer service related communications from us.

 

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws. For additional information regarding your choices, please visit our About or Ads page.

1F - Data retention

We will retain your personal information for the period necessary to fulfil the purposes outlined in this Notice unless a longer retention period is required or permitted by law, for legal, tax or regulatory reasons, or other lawful purposes.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

1G - Children's privacy

Our services are intended for users ages 18 and older. Accordingly, we will not knowingly collect or use any personal information from persons that we know to be under the age of 18. In addition, we will delete any information in our database that we know originates from a child under the age of 18.

1H - Changes to our Privacy Policy

If we change our Privacy Policy, we will post a new version on our Website, which will become effective when posted. The new policy will apply to all current and past users of the online services and will replace any prior policies that are inconsistent with it. Any use of the website or Website Content that is not expressly authorized herein is prohibited and immediately terminates the license granted herein.

If you subscribe to our email newsletter, make a purchase, submit a message, or initiate any other form of communication with tiberiusart.com, you consent to receive communications from us by e-mail. You agree that all agreements, notices, disclosures and other communications that we provide to you by e-mail satisfy any legal requirement that such communications be in writing.

If you use the website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

2D - Copyright

All Website Content, written, visual or otherwise, is our property or that of our website developer and is protected by international copyright laws. The purchase of any product does not provide the purchaser with any copyright interest or other intellectual property right in the product. All Website Content that is not our property is used with permission. The arrangement and compilation of all Website Content is our exclusive property and is protected by international copyright laws. All software used on the website is our property or the property of our software suppliers and is protected by international copyright laws.

2E - Reviews, Comments, Communications and Other  Content

Visitors may post or submit reviews, comments, suggestions, communications and other information via our website, by email or through one of our website operation partners, or social media channels. You agree not to submit, transmit, or otherwise make available in any manner any content (i) that is unlawful, harmful, obscene, hateful, threatening, abusive, defamatory, harassing, libelous, invasive of another's privacy, or is otherwise objectionable, (ii) that infringes the intellectual property rights of any party or (iii) which contains a chain letter or constitutes any form of commercial solicitation, political campaign, mass mailing, "spam" or software virus. You may not use a false e-mail address or otherwise provide information that would be misleading as to the origin of such content. Although we do not regularly review content you submit, we reserve the right to edit or remove any content that we find objectionable for any reason. The website may contain links to or services offered by third parties that are not under the control of Tiberiusart.com (“Third Party Services”). Any such Third Party Services are provided for your convenience only and you access them at your own risk. Any concerns regarding such Third Party Service should be directed to the particular outside service.

2G - Limitations on liability

We do not accept responsibility that the website, its servers, or e-mail sent from the website are free of viruses or other harmful components. We will not be liable for any damages of any kind arising from the use of the website, including, but not limited to direct, indirect, incidental, punitive or consequential damages. Certain laws do not allow limitations as contained in this clause. If these laws apply, some or all of the above limitations may not apply to you and you might have additional rights.

3 - Terms of Sale

These Terms of Sale apply to all purchases and orders placed by you and all agreements concluded between us in relation to the products and services offered on this website.

3A - Pricing

Notwithstanding the product prices shown on the website, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items shown on the website may be mispriced as a result of price changes that are implemented at or about the time of your visit to the website. If there is a discrepancy in listed price and actual price, we will contact you before processing your order. If you do not want to purchase the artwork at the actual price, we will issue you a refund. If an item’s correct price is higher than our stated price, your sole recourse is cancellation of your order.

We reserve the right to refuse or cancel any order. In such event your sole recourse shall be the return of amounts paid by you related to such order (if any).

3B - Shipping & Handling

Shipping & handling for miniature oil paintings will be calcualted and added during checkout. We use USPS to shipping Kiry Tiberius' miniature paintings.

 

The cost for Shipping & Handling of giclee prints is not included in the list price and is not added during checkout. Upon receipt of your order:

  1. We will contact you to confirm your order and verify the cost of shipping as determined by the printer.

  2. We will email you an invoice for the balance owed.

  3. When the invoice is paid, we will process your order with the printer.

 

Please allow up to 5 days to confirm details and process your order. Once the order is processed, it will take 7-10 days for you to receive your print.  Overnight and Expedited Shipping (2-3 Days) is available for an additional fee.

 

The print will arrive rolled in a protective tube. The customer is responsible for stretching and framing the print. 

We reserve the right to refuse or cancel any order. In such event your sole recourse shall be the return of amounts paid by you related to such order (if any).

3C - Return Policy

We do not accept returns nor issue refunds or exchanges. 

 

If you choose to cancel your order before paying the invoice for Shipping & Handling, we are happy to refund you the price paid for the print. Once you submit payment for the Shipping & Handling, we can no longer cancel the order nor issue a refund.

3D - Damaged Artwork

Insurance will be included in the Shipping & Handling invoice for giclee prints.

 

If you notice any serious damage to the outside of the package please do not sign for the delivery and contact us immediately.

​

Because your print will arrive unframed, unstretched, and rolled in a tube, we highly recommend that you leave all unpacking and handling of the artwork to a trusted professional framer or art handler in order to avoid accidentally damaging print.

3E - Disclaimer

We are not liable for any financial damage (including but not limited to the cost of any replacement purchase) that may occur because of non-timely arrival or any lack of availability or conformity of the product.
